We provide a Mastodon Server (https://apobangpo.space), a Pixelfed Server (https://pixelfed.apobangpo.art), a Wiki (https://apobangpo.info) and a website (https://apobangpo.website). These services are provided by Jo Kay Web Design Services for BTS and KPop fans. 

• Please read these Terms and Conditions (the ‘Terms of Use’) carefully. By signing up to the Apobangpo services and using, browsing, reading and/or posting on Apobangpo Sites, you agree to our Terms of Use, Community Charter and Privacy policy.
• We reserve the right to change or modify any of the terms and conditions contained here or any policy or guideline of the Apobangpo Sites, at any time.
• Any changes or modifications will be effective immediately upon posting. Notification will be shared via Server and Website announcements only. Your continued use of Apobangpo Sites after the posting of changes or modifications will confirm your acceptance of all changes or modifications.

1. Definitions:

• Apobangpo Sites: Refers to the Apobangpo Mastodon Server (https://apobangpo.space/), the Apobangpo Pixelfed Server (https://pixelfed.apobangpo.art), the Apobangpo Wiki (https://apobangpo.info) and the Apobangpo Website (https://apobangpo.website/).
• We, Us: Refers to Jo Kay Web Design Services and Moderators appointed to act on our behalf to support Apobangpo Sites. 
• Army: Refers to BTS Fans, commonly known as ‘BTS ARMY’ 
• Apobangpo Community: Users who have joined the Apobangpo sites or are on the waiting list to join.
• Content: Any text, images, gifs, videos or other digital content that is published on Apobangpo Sites. 
• You: The individual user who has signed up to access and use the services provided by Apobangpo Sites. 
• Community Charter: The server rules that apply to all users and are also used to define moderation strategies used to manage Apobangpo Sites. 

2. Who can use the Apobangpo Sites?

• The Apobangpo sites are designed for BTS amd KPop Fans, however other users are also welcome, provided they follow the Community Charter.
• Apobangpo Sites Users must be 18 years and older. Minors (those under 18 years) are not allowed to join our sites.

3. Community Charter

• The Apobangpo Community has worked together to create a Charter that describes our expectations of each other. Please refer here for further information.

• We reserve the right to limit or suspend users who break the rules and expectations described in the Charter.

4. Content on Apobangpo Sites 

• You are responsible for your use of the Apobangpo services and for any content you provide, including compliance with applicable laws in Australia (where this service is hosted). You should only publish content that you are comfortable sharing with others, and that is in line with our Community Charter (Server Rules). 
• You may not transmit any content that is unlawful, offensive, upsetting, intended to disgust, threatening, libelous, defamatory, obscene or otherwise objectionable.

Examples of objectionable content includes, but is not limited to:

• Unlawful activity of the promotion of unlawful activity.
• Defamatory, discriminatory, or mean-spirited content, including negative references or commentary about religion, race, sexual orientation, gender, national/ethnic origin, or other targeted groups.
• Spam or machine generated content that contains unauthorized or unsolicited advertising, or unauthorized solicitation.
• Containing or installing any viruses, worms, malware, trojan horses, or other content that is designed or intended to disrupt, damage, or limit the functioning of any software, hardware or telecommunications equipment or to damage or obtain unauthorized access to any data or other information of a third person.
• Infringing on any proprietary rights of any party, including patent, trademark, trade secret, copyright, right of publicity or other rights.
• Impersonating any person or entity including the Apobangpo Administrators and Moderators. 
• Violating the privacy of any third person.

5. Reliance on Content

• Any use or reliance on any Content posted via Apobangpo Sites, or obtained by you through these sites is at your own risk.
• We do not endorse, support, represent or guarantee the completeness, truthfulness, accuracy, or reliability of any content or communication posted.
• We do not endorse any opinions expressed by users on Apobangpo Sites.

6. Content Backups

• Although regular backups of Content are performed, this does not guarantee there will be no loss or corruption of data.
• We will provide support and attempt to troubleshoot any known or discovered issues that may affect the backups of content.
• You acknowledge that we have no liability related to the integrity of content or the failure to successfully restore content to a usable state.
• You agree to maintain a complete and accurate copy of any content in a location independent of Apobangpo Sites.

7. Content Moderation on Apobangpo Sites 

• We reserve the right to remove content that violates the Community Charter (Server Rules) or Terms of Use, including copyright or trademark violations or other intellectual property misappropriation, impersonation, unlawful conduct, or harassment. 

8. Your Rights and Grant of Rights

• You retain your rights to any content that you submit, post or display on or through Apobangpo Sites. What’s yours is yours. You own your Content (and your incorporated audio, photos and videos).

• You confirm that any content you publish is yours (you own it) or you have the right to use it, and that posting the content on or through Apobangpo Sites does not violate the privacy rights, publicity rights, copyrights, contract rights or any other rights of any person.

• By submitting, posting or displaying content on or through Apobangpo Sites, you grant us a limited, non-exclusive, royalty-free license to use, copy, store, display, share, distribute, communicate and transfer such content for the purpose of delivering the Apobangpo Services.  

9. Content and Copyright

• If you believe that your Content has been copied in a way that constitutes copyright infringement, please report this to copyright@apobangpo.website.

10. Your Accounts

• You will need to create accounts to access/post to Apobangpo sites.
• You are responsible for safeguarding your accounts. Use a strong password.
• We cannot and will not be liable for any loss or damage arising from your failure to comply with the above.
• Two-Factor Authentication tools are available in the preferences for your accounts. We recommend that you use them.

11. Data Protection and Encryption

• Do not share any sensitive information over the federated Apobangpo Sites (Mastodon and Pixelfed) or any other server (instance).
• Private messages are  not secured with end-to-end encryption.
• It’s good practice to be careful what you say in messages and to limit sensitive subjects to alternative, encrypted options.
• You are responsible for choosing what to publish via Apobangpo Sites.  Use alternative and encrypted tools where appropriate. 

12. Permitted Use

You are not permitted to use Apobangpo Sites other than for the following, private, non-commercial purposes:

• viewing these websites;
• participating in the discussion on Apobangpo’s Mastodon server by posting, commenting and sharing within the fediverse ecosystem;
• commenting on blog posts;
• participating in surveys and competitions;
• transferring to other websites through links provided on this website; and
• making use of other facilities that may be provided on the website.

13. AI and Scraping 

• The use of automated systems or software to extract data from Apobangpo Sites for commercial or research purposes, or for AI training purposes, (‘scraping’) is prohibited unless the third party has directly concluded a written licence agreement with Jo Kay Web Design Services.
